10004 Polio Takes Life of Mrs. Russell Ormseth
Polio struck swiftly and stealthily to end the life of a young mother of three small children as she was being rushed in an ambulance to University hospital in Minneapolis for treatment late Sunday afternoon. Mrs . Russell Ormseth, 25, lapsed into unconsciousness near Glencoe and died a few moments later at 4:45 p.m. Mrs. Ormseth had a sore throat and had not been feeling well early last week but when she apparently recovered she and her husband decided to spend the remainder of his vacation in northern Minnesota. They were visiting at the home of Mr. and Mrs. Russell Rasmussen, former Canbyans, in Taconite, when the illness returned and early Sunday morning a doctor was called. He diagnosed it as a mild case of polio. At 2 a.m., they started back to Canby and when they arrived consulted a Canby doctor who advised going immediately to University hospital. As they neared Glencoe, Mr. Ormseth suggested that his wife try to sleep and she said she did feel tired and in a few minutes was asleep. She had been asleep a few minutes when Mr. Ormseth noticed that a pulsation in her throat had ceased and he called to Victor Larson, driver of the ambulance, to stop. They tried artificial respiration but she did not respond. Mr. Larson drove the ambulance into the Glencoe business section where a doctor said she was dead. Her death was from the only known case of infantile paralysis in the Canby community.
Funeral services took place at Our Saviour's Lutheran church Wednesday afternoon with the Rev. O. H. Hove officiating, and burial was made in the Canby cemetery. During the service Henry Peterson sang "Nearer My God to Thee" and "Beyond the Sunset" with Mrs. Donald Peterson accompanying on the organ. Pallbearers were Ovie Carlson, Oscar Bengtson, Nils Lundvall, James Wiest, Alton Olson and Lester Bockes.
Dorothy Shippy, daughter of Mr. and Mrs. Ralph Shippy, was born August 9, 1927, in Canby and she lived her entire life in the Canby community, attending rural school in Lincoln county and graduating from Canby high school in 1946. After graduating she was employed in Woodward's and Lyslo's Grocery. She was married to Russell Ormseth in St. Stephen's church May 11, 1947. Three children were born and survive with their father. They are James Curtis, 4; Richard Lee, 2; and Carol Jean 10? months. Also surviving are her parents; a sister, Arlys Shippy, and two brothers, Wilbur and Wayne Shippy. Mrs. Ormseth was a member of the Circle of Our Saviour's Lutheran church and the American Legion Auxiliary.

?b?James Fumerton's Death?/b?
In a will dated 1871-04-05 (a few days before his death ) he left his estate to his wife and after she died to be equally divided between their children William John; James Henry; Thomas Alexander; and David Lockart. The will uses the Fummerton spelling but is signed with his mark so James was illiterate. It would appear that James died following some kind of accident as his death was sudden. Allegedly he died from the effects of fighting "the great fire".

Buried with his wife at St. Filians Cemetery, Beckwith Twp. Grave stone suggests be was born 1830. Death notice in Perth Courier dated 1871-05-05 indicates James was 40 yrs on his death. James is also buried in the same plot, C4, as his sons Wm J. Fumerton and James H. Fumerton and daughter Margaret J. Fumerton.

10013 Powlett v University of Alberta, [1934] 2 WWR 209
A.L. Smith was a formidable criminal trial lawyer who was nationally respected. During a courtroom skirmish, no one could better articulate and apply the rules of evidence, practice and procedure. During his career, A.L. Smith was associated with many of Alberta's great law cases including Powlett vs. University of Alberta (hazing case), Solloway & Mills (bucket shop brokerage house bust), The Corona Hotel fire, and MacMillan vs. Brownlee.

EDMONTON
A Calgary lawyer took the University of Alberta to court claiming his son was insane and in a mental institution in Ontario because of physical violence he suffered during initiation hazing in 1932, his freshman year as a law student.

Horatio Powlett filed the lawsuit on behalf of his 19-year-old son Armand Powlett. It sought $200,000 in damages from the university, its board of governors and senate committee.

The case was heard in supreme civil court (now the Court of Queen's Bench) and examined the responsibility of the university for the activities of its students in conducting initiation ceremonies. Forty witnesses testified during the two-week trial.

Powlett's father told the court that during the initiation his son was told to go to Assinaboia Hall men's residence from Athabasca Hall, his residence, wearing only a dressing gown. He was one of eight freshman stripped of their clothing before taking part in a chariot race. Losing teams were tubbed made to stand under a cold shower.

Powlett was also made to crawl on his hands and knees through an arch of students' legs and spanked.

When he shared this information with Dr. Egerton Pope, director of medical services, the elder Powlett said he was told Pope knew all about it and told him the boy had always been of unstable mind and even without the initiation he would have become insane shortly.

Later in the trial, a Montreal psychiatrist who examined Armand Powlett testified that he had recovered his mental health to where it was before he entered the U of A and could be de-institutionalized.

In his ruling of Oct. 28, Justice William Carlos Ives awarded Powlett and his son $56,860 in compensation.

I have no hesitation, whatever, in finding that the mental illness of the infant plaintiff was caused by the proceedings of initiation to which he was subjected.

With equal clarity there emerges negligence on the part of all the defendants who being aware of the institution of initiation gave it tacit approval and permitted it to be carried on without any proper supervision, the judge said.

The case led to the university abolishing freshman initiation in 1933.

More recently, a U of A fraternity, Delta Kappa Epsilon, lost its formal status as a student group for five years after an investigation into allegations of hazing in 2011. A video allegedly showed people yelling at new recruits, telling them to eat their own vomit and closing them in a plywood box during an initiation weekend. The fraternity regained full status early in the fall of 2013, after demonstrating good behaviour and community leadership.

Land Grant 'Perth Settlement' given to Soldiers 21 Dec 1821, Con 3 NE1/2 Lot 3 Beckwith Township. Arrived too Late to serve in action.
Biography
Thomas was born c.1792 in England, likely somewhere in northern England. His parents and precise birthplace remain unknown as of Jan. 2019.

Thomas Lawford came to Canada in 1817 as a soldier in the 37th Regiment. Following his discharge, Thomas made his way to Perth, Ontario, at the time a military settlement encampment. Receiving a 100 acre land grant in Beckwith Township (East half of lot 3, Conc. 3), Thomas set to work transforming his land into a productive farm operation.

Thomas married Margaret Cameron at Perth in 1825 and they raised a large family of six boys and six girls. Thomas passed away 6 Dec 1880, aged 88, and Margaret died in June 1891, aged 86. On his civil death record, the registrar wrote: "An old soldier and pensioner."[1]

The following account was written by Scott Manning based on search of British military records:

Thomas was a discharged British soldier who served with the 2nd Battalion of the 37th Regiment of Foot, otherwise known as the North Hampshire Regiment. Hoping to learn where Thomas was from in England, I retained a researcher in 1983 to search Thomas' military service records at the National Archives in London, England. His findings are summarized as follows.

Thomas enlisted as a volunteer at Northumberland, the most northerly English county bordering Scotland. When the 2nd Battalion was formed in May 1813 Thomas' name appears on the muster rolls as returning from furlough but there is no mention of where he was stationed beforehand. The thread of his whereabouts disappears prior to 1813 as the researcher was unable to find any trace of Thomas before that time, having checked muster rolls of both the 1st Battalion and the Northumberland militia.

Regarding Thomas' service with the 2nd Battalion, he was stationed in Belgium (Antwerp) from late 1814 into 1815. Later in 1815, his battalion was stationed at Fermoy, Ireland, a garrison town where a large number of British troops were massed prior to their departure for the battlefield near Waterloo, Belgium. So on June 18, 1815 at the age of 23, Thomas fought in the Duke of Wellington's army at the Battle of Waterloo and a family story passed down confirms that Thomas was wounded on the battlefield.

After Waterloo, Thomas was again stationed at Fermoy Barracks until early 1817 when his Battalion was disbanded and the remaining 432 men were sent to Canada to join the 37th Regiment's 1st Battalion. Arriving in the summer of 1817, Thomas was stationed in Montr?al from June 1818 until his discharge on 3 May 1820.

Following his discharge, Thomas received a land grant to the East 1/2 Lot 3, Conc. 3, Beckwith Township, Lanark County, ON.

Given his enlistment in Northumberland, Thomas Lawford could have actually come from somewhere in northern England. Moreover, his civil death record and gravestone strongly suggest he was born in 1792.
